The Services are available to Subscribers, who may grant access to their employees, independent contractors, clients, and other authorized users ("End Users"). You agree to use the Services only for lawful purposes in accordance with these Terms.

3. Account Registration and Security

To access certain features of our Services, you must register for an account with Smart Pulse. You are responsible for providing accurate, current, and complete information during the registration process. You are also responsible for maintaining the confidentiality of your account information, including your login credentials, and for all activities that occur under your account.

4. Subscription Fees and Payment

If you are a Subscriber, you agree to pay the applicable subscription fees for the Services, as outlined in your agreement with Smart Pulse. All fees are due in accordance with the payment terms specified during the registration process. You are responsible for providing accurate billing information, and you agree to keep your payment details up to date.

5. Use of the Services

You agree to use the Services in a manner consistent with applicable law and our policies. You will not use the Services to:

Violate any local, state, national, or international law or regulation.Infringe upon the intellectual property or privacy rights of others.Transmit any harmful or malicious content, including viruses or malware.Engage in activities that could harm or disrupt the functionality of the Services.

6. Privacy and Data Collection

To the fullest extent permitted by applicable law, Smart Pulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, arising from your use of the Services. Our liability shall be limited to the amount you paid for the Services within the last 12 months.

You agree to indemnify and hold harmless Smart Pulse, its affiliates, officers, employees, agents, and service providers from any claims, damages, losses, liabilities, or expenses (including attorney fees) arising out of your use of the Services or your violation of these Terms.

In the event of a dispute, you agree to first attempt to resolve the matter through informal negotiations with Smart Pulse. If informal negotiations fail, any legal action shall be brought exclusively in the courts located within the jurisdiction of Smart Pulse's principal office.
